CHILD SUPPORT

In New York, parents have an obligation to provide financial support to a child until age 21. In general the Child Support Standards Act (the "CSSA") sets a parent's support obligation based upon the parent's pro rata share of the combined parental income and the number of children in the family. The parent who has physical custody of the child is the one entitled to receive child support. The CSSA also provides for a sharing of the costs of a child's medical, child care and, in some cases, educational expenses based upon each parent's pro rata share of the combined parental income. The income of our clients will usually exceed the maximum CSSA guideline amount which requires a presentation to a court which reflects the needs and equities of a child support award.  A negotiated settlement does not necessarily have to follow the guidelines.  For detailed information about all of the factors used in determining child support, please consult the New York Domestic Relations Law Sections 240(1)-b.
