EQUITABLE DISTRIBUTION

All New York divorce cases require an equitable division of property.  Often the valuation and division of property is straight forward, particularly where the parties are happy with an equal split.  Since the statute does not require or even suggest an equal division of property, the lawyer has to analyze the value of property and appropriateness of the division in light of the circumstances.  This process may involve working with court appointed or hired valuation experts.  Valuation analysis can be complex and requires particular aptitude and understanding.  We pride ourselves in being able to bring such expertise to  cases which may involve such issues as valuing closely held assets, blocks of stock in publicly traded companies, control positions, and intangible assets such as goodwill, licenses and enhanced earning capacity. Our philosophy is that we should help the expert develop the valuation opinion by making sure he or she has at least considered the arguments which are most advantageous for our client and that we should proactively advocate for those positions.
